Kind of undermines the entire rationale for drug testing in the first place.
It's already undermined unless they're also testing for the impairing drug alcohol; how many employers have ever done that?
I think there are two reasons for drug testing.
1. One as a pre-employment screening, and I think that’s what the article is looking at, with the argument that marijuana is becoming like alcohol use.
However the MAIN REASON for an employer to test for drugs including marijuana, and maybe the only reason, is to negate an injury if it occurs while the person is using.
AND I KNOW, I CAN HEAR EVERYONE NOW SAYING JUST BECAUSE THERE’S MARIJUANA IN SOMEONE’S URINE AFTER HE’S CHOPPED HIS FINGER OFF, DOESN’T MEAN HE WAS IMPAIRED.
In the real world, the Worker’s Comp Carrier will fight the case hard and will win it. At least here in Georgia.
