It should be tossed because he didn’t get legal representation. His own lawyer declared him guilty.
His accuser? James Comey’s FBI, which we now know will go to incredibly extreme lengths to frame an innocent party.
IMO Dzohkar didn’t do it, and didn’t know anything about it.
Why do you think he didn’t do it?
You think he was set up by Comey? They had video of him placing the backpacks. What, you think he did know why he was placing backpacks or what was in them? The whole family knew how to make bombs. His friends said he told them he knew how to make bombs.

April 21, 2013 – Dzhokhar tells FBI the bombs were made in Tamerlan and Katherine’s (age 24) 800 sq ft Cambridge apartment and they upped the original Fourth of July date to the marathon because they finished the bombs early. They were going to detonate the bombs at the Charles River Esplanade celebration. Another site would have been Times Square, NY. That they acted alone and that they learned how to build pressure cooker bombs from an online al Qaeda magazine, Inspire.
Nov. 4, 2014 – Ailina Tsarnaeva, 24, pleaded guilty to misleading a police detective during a counterfeiting investigation, avoiding jail time in an agreement with prosecutors in South Boston Municipal Court. Prosecutors also considered separate charges pending against Tsarnaeva in New York, where she is accused of threatening to “put a bomb” on a perceived romantic rival. “I have people who can go over there and put a bomb on you.” She left the courtroom with a baby.
Mar 4, 2015 – Katherine Russell is suspected of accompanying Tamerlain to Macy’s in Boston two months before bombing to purchase 5 pressure cookers, two of which were allegedly used at the bombing. The bombs were made in their apartment in plain sight of her.
