Roberts declared it a tax. Tax was removed.Also, Roberts said that it would otherwise be Unconstitutional. He said neither the Commerce Clause nor the Necessary and Proper Clause gave Congress to enact Obamacare.

So if this really is going to hurt millions of people desperate for health care, then they can reinstate a penalty of $1 so that it is again a tax.
