Flynn says FBI pushed him not to have lawyer present during interview

In a lengthy court filing Tuesday, attorneys for former National Security Adviser Michael Flynn alleged that then-FBI Deputy Director Andrew McCabe pushed Flynn not to have an attorney present during the questioning that ultimately led to his guilty plea on a single charge of lying to federal authorities.

The document outlines, with striking new details, the rapid sequence of events that led to Flynn's sudden fall from the Trump administration. The filing also seemingly demonstrates that the FBI took a significantly more aggressive tack in handling the Flynn interview than it did during other similar matters, including the agency's sit-downs with Hillary Clinton and ex-Trump adviser George Papadopoulos.

While Flynn is among several Trump associates to have been charged with making false statements as part of the Russia probe, no one interviewed during the FBI’s Clinton email investigation was hit with false statement charges – though investigators believed some witnesses were untruthful.

Oldest law enforcement trick in the world. “Look if you talk to us here and now, there is a good chance we can clear this all up. If you call a lawyer then it will just go on.” Most people talk, either lie (bad) or end up implicating themselves (very bad). Best to remain silent. If law enforcement had enough, you would already be arrested. You can’t help yourself talking to cops even if you are totally innocent.

Unfortunately for Team Mueller and the Deep State Coup Plotters Flynn somehow managed to get ahold of the 302 interview form (posted 7 MONTHS AFTER the fact) as well as confidential testimony from McCabe (presumably from the IG Horowoitz?). Judge Sullivan now has the means to toss this case, and Flynn will be free to civilly pursue McCabe, Yates, Mueller, Lynch, Rosenstein for malicious prosecution like Corsi is doing.

It is unconstitutional for a person to be denied a lawyer. That is what Hillary got fired for when she was working on the Watergate committee.

He should have asked himself - "What Would Donald Trump Do?"

"I will not say a word without my lawyer" and sat there and not saying a word.

I depends on if Flynn was under arrest at the time, or if he were being held without the option to walk out of the meeting.

Was he under arrest at the time? No.

Was he being held in custody? No.

Thus, no reading of Miranda was necessary.

And imagine the trouble they caused because Trump said he’s a nice guy and hoped they could give him a break.

Absolutely correct. NEVER talk to em about anything without an attorney present...even if you’re totally innocent.
I’ve posted this before: Years ago, we had the unfortunate opportunity to have to live next door to an FBI agent. He was somewhat arrogant and pretty much made it known throughout the neighborhood who/what he was.
We had a small backyard with a chain-link fence around it. I was in the backyard with the dog letting it do it’s business one morning. He walked up to the fence and said: “Beautiful morning. I wonder what all the poor people are doing this morning?”
I immediately pled the 5th, grabbed the dog and headed to the house. He didn’t think it was funny......neither did I.

Lots of leftist comments about how he should have been smart enough to know...which a) is beside the point with respect to entrapment and b) makes you wonder “Gee, why would a smart guy who knows better do such a thing anyway?”.

Was Flynn dumb as a rock or clever as a fox?

True but if you think about this, the whole idea of trapping him during the transition is improper. No you can’t lie to federal agents but they have no business asking the National Security advisor questions to lead to charges just before he takes office.
Also suggesting there be no lawyer present is improper.
