Ding Ding... Winner winner, chicken dinner. What the case was about vs what people thought the case was about. Bring an appeal that challenges the court’s ability to perform the state legislature’s function in assigning budgets of state funds that come through federal hands, and I betcha the result would be much different.

Yes, yes, yes, however the State survey agency (SA) has the power to declare Medicare providers unqualified.
State Operations Manual, Chapter 3 is the process to determine if the provider is unqualified. Report is then sent to the Center for Medicare and Medicaid Services (CMS) for review.
To say the State has no oversight and control is asinine based on logistics alone, which is why SA works hand-in-hand with CMS.
