Federal lawsuit aims to force special election for John McCain's Senate seat

PHOENIX — A group of Arizona voters is suing Republican Gov. Doug Ducey to try to force him to call a special election to replace their late Sen. John McCain.

The federal lawsuit announced Thursday alleges that Ducey’s September appointment of Jon Kyl to fill the seat until the 2020 election violates the Constitution.

Ducey spokesman Patrick Ptak called the lawsuit “frivolous” and said the governor executed the laws as required.

That's the question, and it appears that Ducey did follow the law, aided in no small part by McCain's clinging to the seat till the literally the last moment.

When they lose the suit it will give them another bloody shirt to wave for their moonbat base about how everything that passed the Senate during Kyl’s tenure was “illegitimate”.
