A Supreme Court case about jurisdiction in an obscure murder has huge implications for tribes.
On the morning of June 22, 1839, the Cherokee leader John Ridge was pulled from his bed, dragged into his front yard and stabbed 84 times while his family watched. He was assassinated for signing the Cherokee Nations removal treaty, a document that in exchange for the tribes homelands promised uninterrupted sovereignty over a third of the land in present-day Oklahoma. That promise was not kept.
Sixty-seven years later, federal agents questioned Johns grandson, William D. Polson. They needed to add him to a list of every Cherokee living in Indian Territory to start the process of land allotments. Through allotment, all land belonging to the Cherokee Nation the land John had signed his life for would be split up between individual citizens and then opened up for white settlement. And by this grand act of bureaucratic theft, Oklahoma became a state.

Most Native American in Oklahoma were transplants from the east. So they didnt own the land to begin with.
So this really means Liz Warren’s family stole land from the Cherokee. Nor that she is Cherokee. She and her family are land thieves.....

So, the Feds give parcels of land to the Indians who then sell the land to others. Now, the Indians want the land back????

Please—check out red/white relations starting with the organized massacres of settlers in the spring of 1622. How the ‘indian’s’ greatest pleasures came in torturing their captives to death as slowly as possible. Watching their OTHER captives witness the horrors was a major part of the fun.
Note that this was tribes vs. CIVILIAN FARMERS—not at all involving governments.
As for any agreements or treaties—research the term “indian giver”.
This conflict mostly ended with the mass production of the lever-action Winchester ‘73 rifle, again—in the hands of civilians who did most if not all the actual fighting.
By the 1840’s there wasn’t much patience left.
There were. The Goths were foederati to the Romans but then they rose up and took the entire province for themselves. Today it is called Spain. The nations of Western Europe are the successors of the various foederati that overthrew the Western Roman Empire. The reservations swallowed the empire.

Not exactly. They want the land to be considered reservation jurisdiction. Half the states in the union have reservations, and the majority of those have reservations that thanks to allotment have non-Native owned fee land where tribal jurisdiction is already limited.

Whatever. If they have a treaty, the US should honor it.
Since the RATs violated the original treaty, they should give them back all the Cherokee land in Tennesee, Georgia, North Carolina and Alabama as well.
Andrew Jackass marched 13,000 Cherokees from there to Oklahoma in the shameful "Trail of Tears"....4000 died from exposure, marching barefoot in an exceptionally cold winter.
Before forced relocation, the Cherokee Nation was a very advanced culture, having a written language and even a newspaper.
Those Indians got what they considered to be Fair Market Value calculated in wampum and beads.
I believe the federal government took part of the Cherokee lands in Indian Territory from them to punish them for siding with the Confederacy in the War Between the States.
How about half the land in California and New York? In fact, Manhattan should be given back to the tribe it was stolen from - and DeBlasio given the job of head stableboy. :)
