But The President can close the border any time he chooses.
The Executive executes the Laws enacted by Congress. The Laws are already on the books. Just because previous presidents did not enforce them does not mean that they are not the law of the land.
Article clearly states.....”even if Congress were to explicitly say that all aliens seeking admission shall be granted status, the president can still exclude anyone he wants...... Once an alien is ‘lawfully’ admitted, THEN Congress controls the rules of naturalization or deportation, although Justice Thomas believes the president might also have inherent power to deport as well. See Sessions v. Dimaya (2018, THOMAS, J., dissenting, slip op., 1314).
I read that the immigration laws enacted by Congress specifically grant the President the authority to suspend all or part of immigration into the U.S. if events such as this caravan necessitate it.
So the judge is actually telling Congress the courts have the last word on immigration laws.
