I think you nailed it. Yes, possibly a huge loophole.
This is closing a much bigger loophole. As long as catch and release is occuring they come. Once they know they will not be released into the US, the flood drops off to a trickle.

They have been offered jobs and amnesty in Mexico.
Mexico is a ‘safe’ country for them to emigrate in.
These facts also make it not possible for them to come to the United States
International law says people escaping from a brutal country must ask for and accept amnesty in the first safe country into which they pass.
