I’m not throwing up the white flag in general, just this particular issue with the 9th Circuit is very unlikely to change anytime soon. Lots of other places are more likely for progress.
I can only speak for myself but I’ve watched this President accomplish things I would never have thought possible ....so I won’t underestimate what is or not possible with the 9th court. He is a man who loves leverage and often throws things out there to get the rats pants in knots.....and it usually does.
