Three Democratic senators on Monday filed a lawsuit in federal court challenging the constitutionality of President Trumps appointment of Matthew Whitaker as acting attorney general.
Whitaker was appointed by Trump to lead the Justice Department after Attorney General Jeff Sessions was forced out of the role earlier this month.
Connecticut Sen. Richard Blumenthal, Rhode Island Sen. Sheldon Whitehouse and Hawaii Sen. Mazie Hirono filed the complaint against Whitaker in the U.S. District Court for the District of Columbia on Monday. All three issues fiery statements.
Installing Matthew Whitaker so flagrantly defies constitutional law that any viewer of School House Rock would recognize it. Americans prize a system of checks and balances, which President Trumps dictatorial appointment betrays, Blumenthal said.
"The stakes are too high to allow the president to install an unconfirmed lackey to lead the Department of Justice a lackey whose stated purpose, apparently, is undermining a major investigation into the president, Whitehouse said.
Donald Trump cannot subvert the Constitution to protect himself and evade accountability, Hirono said.
The senators argue that Whitakers appointment is in violation of the Constitutions appointments clause. They ask the federal court to declare Whitakers appointment unconstitutional and block him from carrying out duties.

The result is that Democrats can judge shop and sue over anything they please, often successfully.
It is time for the president to go Andrew Jackson on the Democrats and their corrupt judges. When Democrat judges make rulings that they have no constitutional right to do so, the president needs to say, not going to do it.
Can you imagine the total democrat meltdown and freakout if Trump said, “Ok then, as Chief Executive I’m exercising my Presidential authority and taking direct control of Judiciary, I will be running it out of the Oval Office.” To do so is well within his Constitutional powers to manage the executive branch reside with the President and power is simply “vested” to an appointed cabinet secretary.
