In principle, the federal government accepted a version of this argument years ago.
I know this to be true because we do it in CO all of the time, and NM has done it. Where I grew up in NM, there can be fires that people don't know about until they are over. The only firefighting that is done on the far back country fires is major structure protection... which may be a house or two. And the terrain is so rugged that it is not possible to go on a routine basis and "manage" the forests.
