Bottom Line in Florida: Broward County Election Officials Have Been Violating the Law

By now, you know that Republicans are raising the alarm over what's happening in Florida, as the margins apparent election night GOP victories -- punctuated by Democratic concessions -- are being whittled down in a heavily blue county. As expected, Democrats are falsely accusing the GOP of wanting to stop the process of counting votes. Republicans counter by raising a top Broward County election official's known history of malfeasance and incompetence, aggressively accusing the opposition party of try to steal an election, noting that the county has "discovered" tens of thousands of votes since election day, refusing to say how many more there are, or where they've been. Some of this may be dismissed as partisan shouting over the dramatic denouement of yet another tight Florida contest. But it's important to understand that overwhelmingly liberal Broward and Palm Beach Counties have been in ongoing violation of election law. That is the central issue here:

The lead for Scott is still 15,000 and for DeSantis, it’s 36,000. The dems are out of altitude and airspace.

In Florida

(5)A ballot shall be counted only if:
(a)It is returned in the return mailing envelope;

(b)The elector’s signature has been verified as provided in this subsection; and

(c)It is received by the supervisor of elections not later than 7 p.m. on the day of the election.

The supervisor of elections shall verify the signature of each elector on the return mailing envelope with the signature on the elector’s registration records. Such verification may commence at any time prior to the canvass of votes. The supervisor of elections shall safely keep the ballot unopened in his or her office until the county canvassing board canvasses the vote....

(6)The canvassing board may begin the canvassing of mail ballots at 7 a.m. on the sixth day before the election, including processing the ballots through the tabulating equipment. However, results may not be released until after 7 p.m. on election day. Any canvassing board member or election employee who releases any result before 7 p.m. on election day commits a felony of the third degree...

101.67;Safekeeping of mailed ballots; deadline for receiving vote-by-mail ballots.—
(1);The supervisor of elections shall safely keep in his or her office any envelopes received containing marked ballots of absent electors, and he or she shall, before the canvassing of the election returns, deliver the envelopes to the county canvassing board along with his or her file or list kept regarding said ballots.

(2);Except as provided in s. 101.6952(5), all marked absent electors’ ballots to be counted must be received by the supervisor by 7 p.m. the day of the election. All ballots received thereafter shall be marked with the time and date of receipt and filed in the supervisor’s office.

Listening to Rush talking about this today, Broward and Palm Beach aren't even being discrete. Almost three full days after the polls closed, they are still "finding" (i.e. manufacturing) additional votes for losing Democrat candidates in blatant, in-your-face violation of election laws enacted specifically to prevent exactly what it is that these election officials are doing.

There is no way I can see that Florida's overwhelming Republican-controlled state government will allow this to stand. President Trump certainly won't. Florida is vital to his reelection strategy.

Sadly, the Dems are not out of somebody else’s money, unconstitutional federal taxes a great example.

Republicans winning Florida is not the real problem imo.

The problem is that Florida has a history of rigged elections.

This must stop.

Patriots must support Pres. Trump in leading the states to repeal the ill-conceived 17th Amendment, the “broomstick of the wicked witch.”

Consider that the repeal amendment need a provision to prohibit political party support for federal politicians elected by ordinary voters.

The 16th Amendment needs to disappear too.

One article said after Bush V Gore, they went to electronic voting then went BACK to paper ballots at some point. Except they’re not punch cards now, I guess they’re things people actually write on...as if THAT is any more reliable. Are they insane? I can’t understand people thinking it’s better to stay in the dark ages technologically.

If you have to rely on humans reading and counting ANYTHING, you open things up to errors and very easy fraud. You can’t “throw out” electronic votes. You can’t “find” electronic votes. And you can’t miscount or misread them.

101.5614 Canvass of returns.— (1)As soon as the polls are closed, the election board shall secure the voting devices against further voting. The election board shall thereafter, in the presence of members of the public desiring to witness the proceedings, verify the number of voted ballots, unused ballots, provisional ballots, and spoiled ballots to ascertain whether such number corresponds with the number of ballots issued by the supervisor. If there is a difference, this fact shall be reported in writing to the county canvassing board with the reasons therefor if known. The total number of voted ballots shall be entered on the forms provided. (4)(a) If any vote-by-mail ballot is physically damaged so that it cannot properly be counted by the automatic tabulating equipment, a true duplicate copy shall be made of the damaged ballot in the presence of witnesses and substituted for the damaged ballot. Likewise, a duplicate ballot shall be made of a vote-by-mail ballot containing an overvoted race or a marked vote-by-mail ballot in which every race is undervoted which shall include all valid votes as determined by the canvassing board based on rules adopted by the division pursuant to s. 102.166(4). All duplicate ballots shall be clearly labeled “duplicate,” bear a serial number which shall be recorded on the defective ballot, and be counted in lieu of the defective ballot. After a ballot has been duplicated, the defective ballot shall be placed in an envelope provided for that purpose, and the duplicate ballot shall be tallied with the other ballots for that precinct. (b) A true duplicate copy shall be made of each federal write-in absentee ballot in the presence of witnesses and substituted for the federal write-in absentee ballot. The duplicate ballot must include all valid votes as determined by the canvassing board based on rules adopted by the division pursuant to s. 102.166(4). All duplicate ballots shall be clearly labeled “duplicate,” bear a serial number that shall be recorded on the federal write-in absentee ballot, and be counted in lieu of the federal write-in absentee ballot. After a ballot has been duplicated, the federal write-in absentee ballot shall be placed in an envelope provided for that purpose, and the duplicate ballot shall be tallied with other ballots for that precinct. (5) If there is no clear indication on the ballot that the voter has made a definite choice for an office or ballot measure, the elector’s ballot shall not be counted for that office or measure, but the ballot shall not be invalidated as to those names or measures which are properly marked. (6) Vote-by-mail ballots may be counted by automatic tabulating equipment if they have been marked in a manner which will enable them to be properly counted by such equipment. (7) The return printed by the automatic tabulating equipment, to which has been added the return of write-in, vote-by-mail, and manually counted votes and votes from provisional ballots, shall constitute the official return of the election upon certification by the canvassing board. Upon completion of the count, the returns shall be open to the public. A copy of the returns may be posted at the central counting place or at the office of the supervisor of elections in lieu of the posting of returns at individual precincts.

That’s precisely why they don’t use electronic ballots, probably.

I am in Orange, though, and we use paper ballots that are counted electronically. You blacken in a circle and the machine tabulates it. We don’t have that problem. I would not blame the ballots. I would say it’s fraud. Every county in the State can do it except these two. They use the claim of incompetence to cover up their fraud.
