Transgender fight could prove major test for Supreme Court

The fight over civil rights protections for transgender people could prove to be a major test for the Supreme Court, particularly its conservative wing, as justices weigh whether to take up the issue this term.

The court has a request before it to hear a case challenging whether civil rights laws that prohibit discrimination on the basis of sex in employment extend to transgender workers.

It’s a dispute that may have a significant impact on the Trump administration’s reported plans to exclude federal protections for transgender people by narrowly defining gender.

The New York Time reported last week that the Department of Health and Human Services (HHS) is leading an effort to write a rule that defines gender as a biological, immutable condition determined by genitalia at birth, a move that would affect civil rights laws banning gender discrimination in education programs that receive federal funding.

While the pending case before the justices deals with civil rights in the workplace, experts say a Supreme Court ruling could very well affect the administration’s planned gender rule.

“If the Supreme Court took it and held what the majority of courts are holding -- that sex discrimination includes transgender people -- the administration would be hard pressed to go ahead with that rule,” said Diana Flynn, litigation director at Lambda Legal, a group that advocates for LGBT rights.

What’s the fight? Penis = male. Vagina = female. Yes there area few people who have both or neither out there. Nothing to get worked up over.

100 years ago, a man couldn’t have surgery and take drugs to become a “woman.” This is a modern invention no matter how much they want to pretend it’s as old as human history.

I find it amazing and disgusting that we are even having this conversation. On what planet would a Man dressed as a Girl be considered a Girl in the eyes of the law? Anatomy and Biology used to be the standard, why change it?

That is a bit too basic. But what does “civil rights for transgender people” mean?

First, every person in this country has “civil rights” as guaranteed by the federal and state constitutions, the same as every other person, you can’t violate those civil rights just because of a person’s “gender identity” (note that oddly, for owning a gun, we actually DO discriminate against people based on what “society” deems to be “mental disorders”).

And we have been doing sex reassignment surgeries for decades, and those who do this have long been treated as the sex they reassigned to, regardless of their initial biology — they have the “special civil rights” attached to that gender.

And in the rare cases of indeterminate gender, there has been no real fight about the idea that in these cases, gender needs to be picked, and the person has always had the “civil rights” that have been specially assigned to that gender.

Now, we had a big fight over whether using a bathroom is a “civil right”, and we overcame mostly democratic opposition to pass a law making it clear that you could not deny a person the use of a bathroom, or a seat on a bus, or service at a business, based on the race they were born with. (we haven’t yet gotten to where you are allowed to identify as another race).

But now we are in Wonderland territory, where if a man is accused of pulling out his member in front of a woman 30 years ago, he is “disqualified” from serving as a supreme court justice, but if that same man says he thinks he is a woman, and pulls out his member in front of women in a locker room, if the woman complains, SHE is the bigot and should be fired from her job.

BTW, this article does the “fake media” thing, replacing “sex” with “gender”, even though they are now different things; the proposed rule defines “sex”, not gender, and Title 9 is about “sex”, not “gender”.

They are very good at knowing there are 7 types of “humans”.

All of which they think are FINE to kill during their first 9 months, although if they ever actually found a genetic marker that would actually indicate gender dysphoria, or sexual attraction, they would likely want to ban women from testing for that and getting an abortion based on the result.

And they don’t seem to know that the other 5 types are all physically identifiable, and we have appropriate, medical, commonly accepted treatments for them, and it is mostly settled and accepted when a person with one of those 5 markers chooses a sex.

Above is a petition to the American Academy of Pediatrics in response to their new policy that any child or young adult that self-diagnosis themselves to be of the other sex should be affirmed in their transition including non-FDA approved drugs and medical procedures.

I have no doubt that something is going on with these kids. Most of them now are girls, and their idea of becoming a man comes on very quickly. (”Rapid Onset Gender Dysphoria” - ROGD).

Studies indicate it may be a social contagion - like anorexia. But obviously it is rooted in mental development, and in most cases is probably not a biological problem that can successfully be treated with drugs and surgery.

The petition is just getting started. They are hoping for 1200 signatures - just 500 now.

So sad that our kids are going through this with just a rubber stamp of approval by the industry.

We are so attentive nowadays to mental disorders, and quick to act to help correct with counseling and medications, quick to set up support groups, to educate the masses not to treat these people as broken, to acknowledge that mental illness is still REAL illness, and should be treated like that.

Except in this one case, where the government FORBIDS any medical professional from helping in any way, and instead forces them to support and push these kids to ACCEPT their mental illness.

It doesn’t bother me if, in some cases, there is a true disconnect, and that the best way to handle it is to take radical steps, especially in the cases where there is physical abnormality (the other 5 types of “sex” we have noted in rare instances, for example). But given that it seems 80% of children ‘play with” gender roles at some point, and end up staying identified with their birth sex, it seems like child cruelty to force them to transition just because they made the mistake of confessing curiousity to a medical professional.

And given that a significant minority of children today report fears of being accepted, and wanting to be considered cool, and given how “cool” it currently is to be transgender, non-binary, gay, etc amongst their peers, it should be OBVIOUS that a good number of these kids are just trying to “fit in”, the same way that in the past, gay kids forced themselves to have heterosexual relationships to “fit in”.
