Trump Defies California Senators With 9th Circuit Judge Nominations

After months of negotiations and delays, the White House is moving to fill California’s three vacancies on the influential 9th U.S. Circuit Court of Appeals — over the strenuous objections of the state’s two Democratic senators.

President Trump’s nominees for the appeals court — litigators Daniel Collins and Kenneth Lee and Assistant United States Attorney Patrick Bumatay — are all based in Southern California, are prominent members of the conservative Federalist Society, and have worked for Republican administrations.

None of the three were approved by Feinstein or Harris via a process known as a “blue slip,” the senators’ offices confirmed Thursday.

“Last night the White House moved forward without consulting me, picking controversial candidates from its initial list and another individual with no judicial experience who had not previously been suggested,” Feinstein said in a statement.

“Instead of working with our office to identify consensus nominees for the 9th Circuit, the White House continues to try to pack the courts with partisan judges who will blindly support the President’s agenda, instead of acting as an independent check on this Administration,” Lily Adams, Harris’ communications director, said in a statement.

Traditionally, presidents have deferred to home state senators when nominating federal judges, agreeing not to nominate people unless those senators returned their blue slip in support of the prospective judge.

President Trump and Senate Republicans, however, have done away with that custom, angering Democrats as they pushed forward controversial nominees for appeals court posts in Ohio, Minnesota and Wisconsin.

Blue slips are courtesies no longer warranted. Further, the 9th circuit covers an incredibly large area of the US, California making up on a small fraction. In all, it also includes Alaska, Arizona, Hawaii, Idaho, Montana, Nevada, Oregon, Washington, plus the Northern Marian Islands and Guam. Bottom line, who cares what Californian Senators Feinstein and Harris say? If they do not like the nominees, they can use their ‘advice and consent’ role to vote against them when the confirmation vote is taken.

Yes, split up and move the 9th circuit. Maybe Alaska, Washington, Oregon, Idaho, Montana, Hawaii, Guam, and the Northern Mariana Islands in a new circuit, based out of maybe Boise. Leave the 9th circuit with California, Nevada, and Arizona, based out of Reno, Phoenix, or Tuscon?

The Constitution is the law of the land - not customs. No where in the Constitution does it mention or require Senators of a state to approve who the President selects for judiciary appointments. The full Senate will have opportunity to vote the President's judiciary selections up or down. If Feinstein and Harris don't like the way things are done, they can pound sand or take their case to the Supreme court, where they will lose - LOL!!

I love to see powerless democrats! That's all!

While I wholeheartedly agree with everything you wrote, we need to be careful about the statement above. I can distinctly remember the situation right after the 1974 election, when many Dems and media types we’re talking about permanent minority status for the Republicans. Yeah, it really sucked for a few years, but 6 years later the Dems had so over played their hand, plus shown their incompetence, such that we got Reagan and the Senate. Nothing is permanent, but we can extend our run by being careful and responsible, and avoiding arrogance and corruption at the highest levels.

The courts and the administrative state is where the Dims power lies when they are the minority. The administrative state must be dismantled and the judiciary must be brought back into line.

That's an excellent idea! It'd be great if the nastiest beasts amongst that howling herd, especially Nancy Pelosi and "Chucky" Schumer, were tarred and feathered to boot.

Maybe we can have civility again when the Democrats are run out of town on a rail, and the Democrat Party is reduced to permanent minority status.
