Brett Kavanaugh has been confirmed, and he will serve as a justice on the supreme court for the rest of his life. This event assures rightwing dominance of the court for a generation or so we are told. After all, at 53, he is not even the youngest conservative: Justice Neil Gorsuch is 51. The chief justice, who has been there for more than a decade, is only 63. Justice Ruth Bader Ginsburg, by contrast, is 85, and Justice Stephen Breyer is 80. We are in, it seems, for decades of misery for labor unions, voting rights, regulation of businesses and all the rest. Or are we? The logic behind this lost for a generation stuff is simple enough. There are nine seats on the supreme court. All of its members serve for life. The five-justice conservative majority is quite young and seems healthy. Given all that, Kavanaughs confirmation is the final nail in the coffin, isnt it? The ray of hope, if there is one, lies in contradiction of the first of those premises. Nothing in the constitution fixes the number of supreme court seats at nine. The size of the court is set by legislation, and has varied over time. We started with six. Weve gone as high as 10 (when Abraham Lincoln was president, and Congress worried about a reactionary supreme court invalidating his wartime measures). Only recently, Republicans held the court to eight members for a year in the wake of Antonin Scalias death. So, then, the next time the left has some political power, why not just expand the size of the supreme court and add another handful of justices? Make Brett Kavanaugh a gifted and energetic member of a 10-to-5 minority. Dont get mad, in other words: get even.

FDR had to still contend with people who valued the Constitution in his own party. The modern progressives do not. They are all about Arbitrary government.

Precisely. Most FReepers seem to be laughing this off. I’m not. They are serious. It isn’t 1936 anymore. They’ll vote in lockstep just as they did on Kavanaugh.
Accidents involving pillows are much less involved to pull off.
So how do the RATs accomplish this feat? They do NOT hold the Presidency, and they will not “recapture” the Senate. So even if they were able to retake the House ( something that their antics with Kavanaugh have pretty much nixed) just how do they go about packing anything other than perhaps their bags as they are turned out of office in increasing numbers!

Once the Dems get control of the House, Senate and Presidency, they will do it without hesitation. All you guys who are saying the idea was a disaster for FDR aren’t paying attention to current politics.
Dems are determined to win at any cost. It’s like the nuclear option of doing away with the filibuster when voting on Federal Judges, the Dems didn’t hesitate to remove the filibuster under Obama. Republicans will eventually do court packing themselves, but only after Dems do it.

Here’s to hoping that Trump gets to appoint as many SCOTUS justices as FDR ultimately did (7), with solid GOP senate majorities backing him.

It’s a serious threat. FDR only backed down because the court went along with his New Deal legislation, and he didn’t need to any more.
FDR couldn’t get it done at the height of his near-dictatorial powers. Today’s lilliputians couldn’t pack anything but fudge.
The leftists needs to stop worrying about the Supreme Court and start worrying about the military tribunals that they will soon be answering to for their crimes.
