That's in fact the crux of the issue: the Left uses a false narrative about race to whip up a moral panic that justifies nullifying the Constitution by transmuting it into a grant of unlimited power to the Federal government.

Considered soberly, there is a serious question as to whether the political tools and laws needed to overcome social discrimination are compatible with the Constitution.

That doesn't mean some expansion of Federal power might not be desirable: it just means we should think very publicly and carefully about what powers the Federal government should be given and use the amendment process if necessary. This is the opposite of having a privately deliberating cabal of nine institute a case-by-case rolling constitutional convention, exercising an authority never given to them by the Constitution.

But it might also imply there are certain social ills that cannot be "fixed" by governmental authority, because no rational, free man could ever consent to ceding that much of his liberties.
