Kino Jimenez, 30, was charged with theft of person.

he should have been charged with battery for throwing the pop in his face as well.

He could serve time in state jail if convicted, Houston's KHOU-TV reported.

Unfortunately If its his first offense he will probably only get probation. (probation really ought to come with a night in jail IMO)

Correction...... Jimenez has no prior felony convictions.

But likely the felony charge is some kind of assault charge for ‘throwing’ drinks in the kids face or maybe taking something ‘physically’ from someone has more serious charges.
