Conspiracy requires an agreement to commit a crime with another. If Trump had said “make it go away” or “get an NDA” there is no agreement to commit a crime, even if Cohen goes out and commits a crime in carrying out that directive.
Let’s say that President Trump says “Go make a withdrawal from the bank.” Cohen goes and robs the bank. You can’t charge President Trump with conspiracy because Cohen goes out and commits a crime.
That’s why Cohen phrased the “confession” they way he did. It was solely designed to create media headlines. The press then went into full spin mode. That’s what they do, they are enemies of the people.
Unless Trump said “go take campaign funds and make an illegal contribution to pay off these women” there isn’t a conspiracy on these facts.
