A Saudi War-Crime in Yemen? Analysing the Dahyan Bombing

At just after 8:20 in the morning on the 9th of August, a bomb dropped from a Saudi-led Coalition plane struck a busy market area in the center of Dahyan, in Saada Governorate, Yemen. The bomb impacted close to the middle of the main road through the town, causing massive civilians casualties. Tragically, most of these casualties came from a single bus carrying students aged as young as 6 on a religious field trip. Local health officials put the final death toll at 54, including 44 children. The death toll is backed up by significant amounts of video evidence showing the dead bodies of young children.

The Strike:

Due to the large amount of video footage uploaded to social media in the aftermath of the airstrike, it is possible to locate the exact spot which the bomb impacted. This video posted by Mint Press News shows us the direct aftermath of the strike and the bomb crater [Warning: Extremely Graphic].

The Saudis and the Yemens have been squabbling for centuries, probably. An acquaintance was a U.S. advisor to the KSA's armored car brigade in the late 1980s and has a really interesting story of their skirmish with some Yemeni T-72s. He has some nice scars from the experience, none too deep fortunately.

War Is Hell my friend but of course it’s not something we should choose lightly.

The choices made in August 1914 have impacted you, me and the whole world in the last century.

We can’t go back and change what was done then, but maybe we can take things in a new and different direction now and in the future.

I’m with the Saudis on this until we get more info, and it has to be better than this. While both Saudis and Iranians might let their allies use children as human shields, the Saudis know to expect at least some criticism over this. Iran’s been supporting this for years, particularly in Iraq against the U.S.

They know the left lets Iran get away with it. (We didn’t need more reasons to despise the left, but this is a biggie.)

It’s easy to imagine a few lunatic Arabs bombing a bus full of children. It’s much harder to see a Saudi pilot wasting a $22,000 laser-guided bomb on an invalid target.

It’s easy to see the Houthis setting this up. And yes, they’ll gladly use innocent children as long as they’re not their own relatives.

And the left will go along with it. They always do.

A ghastly thread, to be sure, but lest we forget the brutality in the area by ALL parties, we need to, from time to time, take the wider view.

Setting emotion aside we all need reminding that groups generally described as "rebels" don't care for civilians whatsoever, ruthless killers, using them as bait, and as protection from attack, hiding among innocent civilians without a second thought.

From time to time we need to pause and take the wider view :

Under the Rome Statute, “Intentionally launching an attack in the knowledge that such attack will cause incidental loss of life or injury to civilians or damage to civilian objects” is criminalised.

Assuming this summary is correct, the "Rome Statute" makes it almost impossible to fight without being accused of a war crime.

Just more international lawfare aimed against the US and its allies.

Good find. Fortunately, we didn’t sign it.

But it doesn’t matter here anyway. Their Rome Statute quote left out this piece that’s critical: “which would be clearly excessive in relation to the concrete and direct overall military advantage anticipated;”

All the Saudis need to show is that their target was important “in relation to the concrete and direct overall military advantage.” And that’s assuming they even knew about the kids.

And if they didn’t know about the kids, then the calculation goes further in their favor.

Good insight, but lost on the Enemies domestic who are genetically, educationally, historically, emotionally and intellectually indisposed to grasp complicated issues.

I'm not surprised they cut that out: it's like the Hamdi decision where the majority opinion cited a quote supplied by some pinko law professors that elided a passage making it clear that the Geneva Conventions do not apply to non-state actors, so the majority could claim it did.

It's all lies, including "the" and "a."

I had to look up that archaic word and I'm glad I did. As today, dishonest academics warp the legal system. Fake "fact" criminals are not new, nor is any Supreme Court Justice or celebrated Attorney all knowing, and thus susceptible to awful decisions which become precedent, decisions that need to be rectified.

But there is also a gem in the discussion :
"It ruled that the broad warmaking powers delegated to the President under Article Two of the United States Constitution and the principle of separation of powers prohibited courts from interfering in this vital area of national security."

This applies perfectly to our ongoing fight to protect our Southern Border against diseased, criminal, illiterate alien criminals.
The Courts have simply not been vigorously challenged on this point.
