Arizona father accused of killing man who tried to enter teen daughter's restroom stall

A Phoenix father is charged with murder for allegedly killing a man who was trying to get into his daughter's bathroom stall.

Melvin Harris' fiancée, Diana Jackson, says he and his 16-year-old daughter stopped at a convenience store so she could use the restroom. Harris said a man, later identified as Leon Armstrong, tried to get inside the stall with the teen.

They alerted store management and security.

But Jackson believes Harris felt not enough was done about it.

Harris told the security guard to 'take care of the situation, or he would do it himself.'

As they were driving away, Harris spotted Armstrong again and got out to confront him.

Witnesses say Harris then went after Armstrong, repeatedly stomping and kicking him.

"He did was he was supposed to do for our kid," Jackson said. "You cannot tell someone they're wrong for protecting their children."

Armstrong died at the hospital. Harris told police Armstrong took a swing at him first.

Harris is charged with second-degree murder.

Perhaps, but murder was not called for. Even the Godfather refused a request for murder from the guy whose daughter was raped. We really don’t know the full story. Perhaps he thought the bathroom was empty. Hopefully, a good 10 years may show him murder is not the solution.

Why assume the daughter and Harris are telling the truth about the victim attempting to enter the bathroom stall? I had a drunk neighbor try to enter my condo one night, does that justify 2nd Degree Murder? Can we get the victims side of the story? No, because he was murdered by Harris.

There is a lot missing from this story: Was the bathroom stall a separate stall within a multi-stall women's restroom or was this a single occupancy restroom with a door that locks? The TV report states both that Armstrong tried to get into the stall and that Armstrong tried to get into the restroom. In my experience, the Quicktrip restrooms can be single occupancy or multi-occupancy. If this particular restroom is single occupancy, then Armstrong may have been simply pushing on a locked door thinking it is stuck. (I speak from personal experience.) But even if Armstrong actually entered the restroom and was trying to enter an occupied stall, the confrontation took place after the restroom incident when Harris' daughter was no longer at risk. Manslaughter at the very least.

I’d give him an attaboy, buy him a round, and send him home.
Even if the perv was no longer a threat to his daughter, he was still a threat to others.
But the that ain’t the way the law works, and that is probably a good thing.

Agree with your assessment.

Based on what is presented in the story I would not convict of murder. Involuntary manslaughter maybe.

The perv deserved an ass kicking, but the head stomping crossed the line.
