It depends if you are in a two party or one party State in this regard. In a one party state as long as one party to the conversation consents (the taper) it's legal. In two party states both parties to the conversation must consent or its illegal.

Its legal. DC is one party consent.
However the tape of the firing may have been recorded in the WH Situation Rooom which is an SCIF. Recording things in that room is...not legal.

Depends on if you're in a one or two-party state. In Texas, it is perfectly legal for me to record you without your knowledge or permission.

In some states ( California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania and Washington State), you need the consent of all parties involved. In DC, you can record any conversation to which you are a party, without needing permission of the other parties
