The only reason they have the ability is because the government entity who has oversight (Congress) has done nothing. Like most judicial meddling, the judge has usurped a power his office does NOT have.

Because Democrats want to use the judiciary to do things that they could not be caught dead voting for. (Gosh, we didn’t do that. Some judge in Oregon did that.)
They have the power, they do not have the authority.
