Yes, because any apology will only be seen by a small fraction of those who saw the original slander. Sue first, then consider dropping it if a sufficient apology is made.

Sue 1st and decline any apology.

Apologies have become a joke these days and mean zero.

They apologize for getting caught not for the act as they would do it again if they could be guaranteed not to be caught
