The U.S. Court of Appeals for the Ninth Circuit ruled Friday that a lawsuit by supporters of Donald Trump against San Jose police officers who allegedly failed to protect them from an anti-Trump riot in June 2016 could proceed, defeating the citys appeal.
The three-judge panel upheld the lower courts decision that the officers were not entitled to qualified immunity from suit because they violated clearly established rights assuming, for the moment, that the plaintiffs factual claims against them were true.

This is the second ruling in a week that made sense from the Ninth Circus.
Did someone put sanity pills in the water?
Hopefully every cop in the nation hears about this and takes it into account.
Maybe the Notorious 9th Circuit Court is trying to straighten up and fly right. Do that, or risk President Trump chopping the vast territory under 9th Circuit jurisdiction into more manageable (read; less liberally biased) smaller courts.
Who knows if this is a trend and how long it will last?

I bet the mayor had a stand down order . I’d have the police superintendent held liable because that’s where the directives originate. His orders are usually from the Mayor’s office. Sue the city too.

Nope! These decisions depend on who the 3 judges are and how professional/ethnical they are.
However, if the people attacked by Antifa etc win, then it will establish a national precedent for suing the Leftistt thugs and putting the leftist-directed police of California, NYC, Phila, and esp. PORTLAND, that they either do their jobs or get sued, fired, and unable to get another job in law enforcement (because they are insurance liability risks).
The same for the local and state governments where these attacks take place.
The good guys will have a powerful weapon to use against the violent Left including ANTIFA (who can be sued as an organization and their convicted members individually). Who knows what information the plaintiffs will demand from the attackers and their organizations/leaders.
I’m salivating at the opportunities out there to destroy these groups, esp. those funded by Soros, Steyer, etc.

Lawsuit is great ... but theres another opportunity here to promote educating the public on the importance of gun rights.
The most persuasive argument the left has to many Americans wavering on this issue is that such a responsibility should be in the hands of professionals. Well this shows the public cant always rely on professionals to protect them when they should, and why the individual right to bear arms is so important, so folks can protect themselves without relying on someone else.
So aside from the lawsuit, at the next Trump rally there should be a significant number of supporters who open carry their guns and remain outside to protect other supporters entering and leaving the stadium, letting everyone there and in the media know that it was San Jose that showed them it was necessary for them to exercise this NATURAL right that was acknowledged by - not created by - the 2nd Amendmenf.
That is exactly what is going on. Their afraid Congress will break up the 9th.
