Same here. If the guy hadn't backed up and instead continued to attack the man on the ground it would be different. But it looked like he lost his temper seeing his "girlfriend" (nine years and 3 kids ought to qualify a couple as common law married) being harassed, he pushed the smaller man away (no punch), saw him fall to the ground, and then backed away.

What I was taught in a CCW course, that means no immediate lethal threat and no justification to shoot. The guy on the ground just sat up, aimed, and fired. Plain killing, fortunately caught on video so the State's Attorney will have a chance to reconsider. Should she have parked there? Of course not. Is that worth killing somebody? Not in my opinion.
