Not so much in my opinion.

McGlockton was bigger,younger, stronger, and struck without warning. The first blow effectively put Drekjka down and out of the fight. That would have been assault and battery right there. But McGlockton still could have walked away from any trouble. He did not do so.

McGlockton continued in a combat threatening stance for another four seconds. That was a continuation of the fight that made him the aggressor from a legal standpoint and presented a "reasonable" prospect of imminent crippling or lethal injury to Drejka.

Drejka fired only one shot to "stop the threat".

He was clearly within the legal definition of self-defense for the State of Florida.

Drejka may have been a jerk about the parking space. That has no bearing on a claim of self-defense. It is not a crime to be an officious busybody - at least not yet.

The only controversy in this incident arises because the decedent was Black and the shooter was White.

Blacks are supposed to get a pass, no matter how badly they behave towards Whites - or other Blacks. That narrative is not going to continue.

I agree: the deceased was the aggressor and didn't have the sense to back off when the victim pulled a handgun out.

If I were to guess based on the video, the deceased assumed the threatening posture and then proceeded to tell the victim he didn't have the guts to shoot him.

One poor judgment followed by another led to his demise.

No get out of jail free card for him.

Same here. Almost happened to me, when I was young and foolish. Was parked in my car with my girlfriend when another car banged into the rear of mine. I got out and got into an argument with a black guy, grabbed his collar and was about to strike his face when I heard his black girlfriend yelling at me to let him go. Looked up and saw the black woman outside the passenger side pointing a revolver at my face. She was shaking like a leaf in a strong wind, finger on the trigger. I said "Okay, I'm out of here." as I let go and backed off. The guy was inebriated, apparently so was she. Next day, same neighborhood she saw me and said hello, I smiled and said hello back, and that was the end of it. It's a powerful and easy lesson, learning to back off when a gun is in your face.

"This guy -- he did this before," Salous said. "He always hangs out in the parking lot and if he sees someone parking, he just wants to start trouble with people."

Your explanation is just the legal standard that keeps him out of jail.

That would be Florida Statute 776.012 (1)

Use of force in defense of person.

A person is justified in using or threatening to use force, except deadly force, against another when and to the extent that the person reasonably believes that such conduct is necessary to defend himself or herself or another against the other’s imminent use of unlawful force.

A person who uses or threatens to use force in accordance with this subsection does not have a duty to retreat before using or threatening to use such force.

However, a person is justified in the use of deadly force and does not have a duty to retreat if:

(1) He or she reasonably believes that such force is necessary to prevent imminent death or great bodily harm to himself or herself or another or to prevent the imminent commission of a forcible felony; or

(2) Under those circumstances permitted pursuant to s. 776.013.

(3) A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony.

Very good take on the incident. I’ve noticed in this part of Florida that black women drivers just think the traffic laws are merely a nuisance. So if the woman who parked in the handicap parking space is black her infraction does not surprise me at all.

The store owner’s statement is rather ambiguous. Given the statement was made after the incident the owner might have meant people parking in the handicap spot without a sticker. But that is not clear.

I just saw this on liveleak and was going to post the article but it has been posted. Anyway, I would not have shot the guy. Not over a parking spot and getting pushed to ground. They guy was not close to him or beating his head in to the ground like that outstanding youth Trayvon martin. I can see this being pushed into a BLM situation and protest’s galore are probably on there way and of course Trump will be Blamed. We will see if the justus department gets involved.

Did we watch the same video? The one I saw had the deceased clearly backing away when he was shot.
