Yes, it's highly unethical. We are talking attorneys here so ethics are a pretty low bar, but it's even beneath that one.

Possibly. From what I understand if Trump had an expectation that the conversation was private and was not informed that there was even the possibility the conversation could be recorded then it’s a serious ethics violation, not to mention likely inadmissible in court.
Most likely violated wiretap laws in New York or whatever state they were in.
