Gregory Peck did a great job playing Atticus Finch in “Killing a Mocking Bird”, won an Academy Award. But he had a script to help him play his character. He really wasn’t a lawyer. Napolitano often gets it wrong, he’s just the Gregory Peck of Fox News.
Of course, there is a risk. However, if Thomas retires, the court will get a less conservative replacement. A conservative as strong as Justice Thomas will not get confirmed in today's environment or in the foreseeable future. Even with the expected gains in this election cycle, a Trump nominee will still have to attract the squishy RINOs in order to get confirmed and would face the full Bork treatment.
Before we worry about the next nominee, let's get Kavanaugh confirmed. He's in good shape right now but anything can happen once the hearings begin. Kavanaugh is going through another level of vetting altogether which he hasn't faced yet. A couple of RINO defections will make it hard to form a winning coalition.

Sheppard Smith came out as formally gay. I have never heard of Judge Andrew Napolitano doing so. Got a source link for that?

I think nap is correct in his assessment. This nominee will be neutral for the court at best. Defending NSA spying is indefensible. That being said Im going on record now that he will not get confirmed because of his defense of government spying on Americans. I trust the president but I still do not think this guy will get confirmed. We cant have the government collecting unlimited information on all Americans. Databases of everything on everybody are ultimately used against the people in the most horrific ways.

The change in Napolitano dates back to January, 2017. Most Freepers have forgotten the particular incident, but when the big news splash about the "dossier" smear and the alleged former British intelligence asset connection was at it's height in the media, Napolitano made an appearance on Fox in which he claimed the real source was the British GCHQ (Government Communications Headquarters), their intelligence service's component of the co-operative spy network with the US and three other allies.
Napolitano didn't go into more detail, e.g.,, that GCHQ was part of the "Five Eyes" (aka Echelon) spy network operated by the US, Britain, Canada, Australia and New Zealand, or that these countries use this system to circumvent their laws against spying on their own citizens by having their "allies" do it for them and then passing the info along "through channels".
Unfortunately for Judge Nap, even though he didn't give those other details, just the mention of GCHQ got him yanked off the air at Fox. He wasn't seen again for nearly three months, with absolutely no comment or explanation from Fox. When he finally returned, again with no explanation or comment from Fox or him, he had noticeably changed in several aspects of his presentation and demeanor.
These five countries and their intelligence agencies do NOT want public discussion of the Echelon system. I believe he was given a serious "talking to" and explanation of what topics were permitted or off-limits. Anyway, he has changed, and I don't believe he should be trusted.
I don’t agree with Napolitano.
Kavanaugh is good, and I’m mostly happy with the pick. I would’ve preferred Hardiman, but Kavanaugh is good and I think conservatives need to stop hyper-ventilating about it. He’s pretty strong on 2A and religious liberty. He’s definitely more constitutionalist than Kennedy. He’s probably more constitutionalist than Roberts but probable less so than Gorsuch.
So yeah, he probably isn’t who I would’ve picked, but he’s still going to be good for this republic. At the end of the day, Kavanaugh on the court is a win, and I definitely wouldn’t gamble on holding the line on the mid terms in hopes of a more hardcore justice, especially when it is very likely Trump replaces Ginsberg at some point.
When RBG hangs it up and if we’ve done well in the mid terms, then we can put Barrett or Hardiman on the court, and the liberal wailing will be truly glorious to behold.

His retirement will give us a chance to install someone in his place that could extend up to 30 years his judicial philosophy. Good for him on many levels!”
I think he will retire at the end of the court’s term in 2019. He has made indication he wants to take a 2A case and have a clear SCOTUS ruling in favor of individual gun rights before he retires. With Kavanaugh on the court, we may get such a ruling.

I agree with the judge with the lowest hairline here. But Trump whether he made a deal with Kennedy or not seems to think this was good strategy. This Kavenaugh is going to be confirmed. I look forward to hearing about the sniffles of the Notorious RBG.
Kavanaugh was probably the only conservative pick that Trump could make that all 50 would vote for.
I did not know Napolitano was gay either. Didnt set off any gaydar.
