“It’s quite possible that the only reason Kennedy retired when he did was a gentlemen’s agreement he made with President Trump that the president would appoint Kavanaugh, who is Kennedy’s former clerk and friend.”

It's also just as possible that President Trump, while performing due diligence on his list of nominees, consulted with Justice Kennedy about Kavanaugh, told Kennedy that he was at the top of his list, and Kennedy then felt comfortable about announcing his retirement after that discussion.

How’s that any different? Not all deals require the handshake. Both seem to be honorable men. A simple “that would please me” from Kennedy could be sufficient.

I also wrote on here yesterday:

“Expect a special counsel to be appointed to investigate the circumstances surrounding the appointment of Kavanaugh with a view to possible impeachment.”

Next, look for NBC to report based on my comment that Acting Attorney General Rod Rosenstein will expand the mandate of Special Counsel Robert Mueller III to investigate whether Russia colluded with President Trump and Justice Kennedy to interfere in the selection of Supreme Court nominee Bret Kavanaugh!
