I could be wrong but the case was referred to the U.S. Attorney for the Southern District of New York. Judge Kimba Woods is a federal judge appointed by Clinton. Cohen isn’t being prosecuted in a NY State Court, yet.
Me thinks this is a matter that the state is pursuing with the USAO involving property matters. The state has been been trying to get at Trump for some time. So, I would not dismiss this as nothing but BS. Let’s examine a senario: Trump wants to convert a building from rental to condo. There are ways to do that which are questionable but not illegal. Trump approaches Cohen and asks how to do it. Cohen advises the course and they proceed. However, now Cohen is pressured to make a deal so he says Trump came to me and set up something I told him was illegal to do (same facts which he said were questionable when approached by Trump but with this spin become enough to indict). They indict in state court as it is a state matter with the matter of a state indictment of a sitting president not decided. The Gov faced this with Agnew but he negotiated a plea deal so whether he could be indicted was moot. He pled to a tax charge BTW. So, the dems have enough to go to Congress with an impeachment matter around the horn. Mueller and the dems are this sneaky, I would not put it passed them and lastly when an attorney is involved, expect the worse, they are all snakes.
