I’m not so sure of that. Based upon the Supreme Court’s decision earlier this week that the SEC’s ALJs were named in violation of the Constitution’s Appointments Clause (I.e., they should have been nominated by the President and confirmed by the Senate) it’s likely that Mueller likewise should have fallen under the Appointments Clause. I’m awaiting the first defense attorney to make that point now.
