Trump's strategic retreat: The EO Does NOT suggest an abandoned commitment to securing the border.

The media is making hay over President Trump's executive order stipulating that families entering the U.S. without authorization be detained as family units, calling it a 'cave-in' or else, as Washington Post's Karen Tumulty put it, "forced into retreat by babies."

Yeah, sure.

As Brian Joondeph superbly points out here:

Trump’s executive order stipulates that the government will continue to prosecute illegal border crossers. And instead of separating families, they will be kept together, in detention facilities, while waiting for their cases to be heard by the courts.

Is this what Democrats wanted when they urged Trump to use his executive order power? Was this the “cave in” that the media thinks it is? The only cave is where the Democrats will be wandering in come November. Only a day ago Senate Minority Leader Chuck Schumer urged President Trump to, “Sign an executive order to end the separation of families at the border, saying it doesn't require legislation.” He even offered to lend Trump his pen to sign the order.

Be careful what you wish for since you might get it.

My own take on it is that Trump, like a general, executed a careful strategic retreat. He knew the press had a live one with its saturation-coverage of crying toddlers on television, and never mind that they were brought into the U.S. illegally, courtesy of either their parents or the human smugglers they hired. Republicans were caving in left and right, and Democrats were feeling their oats. The amnesty-happy Bush clan had a field day.

What Schumer likely wanted was a return to “catch and release” meaning that no one gets detained. Instead he got the opposite – everyone is now detained. Trump couldn’t resist rubbing salt in Schumer’s butt rash.

I think we have to understand that this is related to the RENO v. FLORES settlement agreement from 1997, which states (among other things) that children detained by immigration authorities must be released “without unnecessary delay” to an acceptable recipient, with parents and legal guardians preferred.

Facilities, such as those seen on the news, are other options when nothing better is available. The important takeaway here is that a minor cannot be detained while a parent is awaiting due process.

When immigration enforcers find a family that is breaking the law, they legally must either

1) Separate the family,

2) Release the family, or

3) Release the family with a court date, and hope the family appears for a trial they know they will lose.

Here’s the question ... WHY ONLY THESE OPTIONS?

What’s another missing option?

here it is — IMMEDIATELY SEND THEM BACK TO THE MEXICAN SIDE OF THE BORDER.

Why was that option never considered?

I wrote this in another thread....

Here is what I predict will happen after Trump’s EO:

Democratic voters who are currently celebrating a “win” will turn against the executive order as they realize it did not achieve the DNC goal of ending the zero tolerance policy.

Next, news will surface that, armed with SCOTUS precedents, an appeals court (almost certainly the 9th Circuit of Appeals) will strike down the executive order as illegal ( BTW, In my opinion, the EO *IS* illegal and an usurpation of the law, so yes, it will and should lose).

Sometime later, the SCOTUS will almost certainly agree, as the legislative landscape will not change. The inevitable conclusion from these events is nearly where we are now:

Trump will square off with the DNC again, insisting that lack of legislation allowing families to be detained together is the cause of families being separated.

This time, most Americans will understand that an executive order can’t keep families awaiting trial together. The only question is, will the DNC be honest about their goal of using the familial separation to end zero tolerance, or will they find yet another way to obscure their true goals?

And by that time, it will be close to the Mid term elections. WE SHALL SEE WHAT THE VOTERS DECIDE....

I got a chance to read the EO last night. Doesn’t look like a retreat to me.

It looks like he’s making the most out of a huge opportunity here. Exposing the fact that this policy has been in place for the last 22 years is one such.

I would have liked to see a Trump tweet thanking Schumer for the pen.....bringing Chuckie into the E/O equation would have silenced the Trump critics.

You should see the preamble of this thing. It’s an indictment on everybody and everything that existed and brought about this problem for the last 30 years.

Take care what you ask for/demand in this world. Your stated desire just may be acted upon.

“Satisfying” some “non-negotiable” part of the agenda may just end up skewering yourself, but that is the price of not knowing how to make a deal.

Donald Trump is thinking in terms of checkmate, not three moves ahead, but sometimes as many as ten moves ahead.
