On Monday, former FBI Deputy Director Andrew McCabe refused to testify to the Senate Judiciary Committee about the IG reports findings on the FBIs handling of the Clinton email investigation.
McCabe invoked his 5th Amendment rights on Monday after failing to receive immunity from prosecution in exchange for his testimony.

That’s not what it looked like to me - Cruz did a good job of proving that either McCabe or Comey was a liar. He eviscerated them, not Wrey.
When Cruz seemingly badgered Wrey regarding which of the two was a liar - and Wrey refused to answer - that was hardly Cruz “eviscerating” Wrey - it actually gave Wrey the opportunity to provide some of the most encouraging testimony all day: namely, he confirmed that there are ongoing investigations surrounding those very questions.
The doom and gloomers here see FBI and DOJ refusals and redactions as part of the deep state cover up - I see it as just what they say it is - they can’t talk about ongoing investigations.
The two huge takeaways from these hearings for me were
1) every single Republican who spoke was united in the belief that Obama’s FBI and DOJ were politically weaponized to rig the 2016 election for Clinton, and that both the Clinton investigation and the RussiaGate investigation were manipulated as part of that rigging, and are therefore discredited. That is huge - the GOP (as bad as they are on borders and globalism) is not going to let Trump be framed, nor let the Democrats off the hook for their abuse of power during the Obama years.
2) if there was any doubt before of whether there were ongoing investigations into deep state abuses under Obama - that doubt was removed yesterday. Wrey and Horowitz both confirmed that repeatedly, and convincingly.
It will be interesting to see whether the same dynamic is evident in the House hearings. I think it will be.
The way I look at this is simple: the FBI and DOJ are holding back information for one of two reasons: A) they are covering up for the deep state, or B) they can’t talk about ongoing investigations.
So, which is it? I say the deep state cover up theory is impossible. The day Trump won the election, any hope of a deep state cover up became a lost cause. Their hopes for a cover up were all pinned on Hillary Clinton winning. That’s why Obama needed her to win so badly. That’s why they went to such lengths. Now that Trump won, there’s no way all these deep staters are perjuring themselves for a lost cause.
That leaves B) the heads of the FBI and DOJ are NOT perjuring themselves, they are NOT lying - they are withholding information for exactly the reason stated: they can’t talk about ongoing cases.
This is good news folks - it’s time to start considering the possibility that the good guys have the upper hand - the bad guys are on the run.
I think you are on the right track. For certain jobs involving public trust, you enjoy rights on the order of what you’d get under the UCMJ.
Essentially, what would result is a reduced expectation of privacy that stopped short of depriving someone of their right to refuse self-incrimination.
So, your 4th amendment rights (papers and person, including your personal electronic accounts and social media - bank accounts) pretty much goes away. Your 5th amendment rights (testimony against yourself) is preserved.
Bring him in anyway.
Ask him tough questions.
And then when he answers, “I refuse to...”, he will condemn himself before the cameras.
Songbird or goto jail. 5th wont help.
I know he has been fired, but pleading the 5th by government employees has become too frequent. McCabe was fired for malfeasance while employed by the FBI. This was before he was charged.
When a Federal employees plead the 5th instead of answering questions about their job duties like Louis Lerner who was not fired by the IRS by the IRS. As far as I know she still hasn't answered questions about her and her department's handling of conservative non-profits.
Oh.. and McCabe did not lose all of his FBI pension.
