It's not just the Army but the military in general. After the first gulf war I was a platoon sergeant for all the conscientious objectors/deserters etc. in the Marine reserves. A lot of them got excited when the other branches started discharging people without brig time. Not the Corps. We put them all in the brig.
That was during the GHWB years.

I’m sure no JAG officer but I don’t believe so.
I’m guessing but I think the Army just wants this thing to go away so he’ll be out of their hair.
The whole thing stinks, his fellow soldiers in his unit spoke out about him deserting and the powers that be ignored them.

I was not Bergdahl's brother in arms. If I were, I'm sure I'd want to shoot him.
Mitigating factors: - He should have never qualified to be in the Army after he couldn't hack the Coast Guard. He was a known nut.
- He was more of an idiot insubordinate than deserter. He wanted to complain, not escape.
- His unit's mission (wilderness OP) and the overarching mission of nation building in Afghanistan were truly idiotic in the great traditions of modern Western military science. Not that he got a vote.
- He spent five years in caged hell and he tried to escape.
- His POW status was exploited by every mission planner in Afghanistan for resources. You could say he was responsible for every casualty that occurred during his captivity. But that's not true.
- Shooting is not good for recruiting that blizzard of snowflakes the next Democrat/Neocon administration will need for the next "counterinsurgency" trillion dollered mission Gains sad sack fanatics with $100 lifetime net worths.
