It’s called the Sepwrate Sovereigns Doctrine. If the same co duct is illegal under both state and federal law, both can prosecute and the President cannot pardon state crimes. New York isn’t my state but I think the biggest issue might be the statute of limitations

Was it a state crime before the proposed amendment?

If not, its ex post facto and can’t be prosecuted.

Only future offenses going forward can be tried.

This is nothing more than liberal virtue signaling.
