The proposed NY law can’t be applied to a past crime.

An ex post facto law is unconstitutional.

If D’Souza commits a state crime in the future, then he could be prosecuted.

But he can’t be prosecuted again for a crime for which he already served time.

I doubt NY wants to open a legal can of worms.

I’d normally quickly agree. However with this bunch, they are past any normal pattern.
