It sounds more like a work accident than a killing. Except that this is Maryland. I'd guess they classified him as a prepper and checked his voter registration, no doubt republican. That's justification to prosecute here in the freak state.

I would agree.
A tunnel digging project on your own property with a willing helper that accidentally gets killed would be no different than a construction crew guy down in a ditch working on a water line getting killed in a cave in or a miscue by the backhoe operator.
