I suggested weeks ago that White House Counsel Don McGahn research that very question. The president, I believe, as the repository of executive power under the Constitution, has the raw constitutional power to make a special appointment of a prosecutor to execute federal law.
However, there are questions as to whether such an appointment would conflict with congressional statutes and would be able to access funds appropriated by Congress to carry out his or her task.
For example, a congressional statute requires that, generally, all litigation on behalf of the United States must be carried out in the DOJ under the AG.
Maybe the best way to accomplish this is for the president to issue an executive order directing the Attorney General or Acting Attorney General to appoint person x as a special counsel to conduct a criminal investigation of these matters.
For example, President Trump could order Rod Rosenstein as Acting Attorney General to appoint US Attorney John Huber as special counsel to undertake such an investigation. Or, if POTUS doesn’t know Huber well enough to have confidence in him (remember how disastrously Sessions’ confidence in Rosenstein has turned out) pick another US Attorney in whom Trump has personal confidence is honest and loyal to the United States instead of to the deep state.
Ditto that to some builder in NY who had to buy a lotta concrete from them, I hear he is pretty fearless too... ;-)

In their stupidity of demanding Attorney General Session ‘wake-up’, means they have no clue how the Justice system is suppose to work. The absolute most AG Sessions can do is indict... He cannot ‘convict’ anyone... Perhaps get a plea deal but it would take a ‘judge/jury’ to convict. I for one do NOT want any ‘not guilty’ decisions by liberal judges/juries ... for the rush to ‘judgment’ trials, these idiots continue to demand. I would rather have the criminals twist in the wind forever than to be called ‘not guilty’.
