As Rudy Giuliani enters the center ring of the legal fight between President Donald Trump and special counsel Robert Mueller, the former New York City mayor is already anticipating one possible battle a subpoena for President Trump to testify. I think it's 50/50, Giuliani, the president's personal attorney, told ABC News regarding the possibility of a subpoena. But I got to prepare for that 50 percent.
As ABC News confirmed earlier this week, the presidents legal team was told by Mueller he could compel the president to testify before a grand jury via a subpoena. As Ty Cobb steps down from his position as White House counsel handling the Russia probe for the presidency, his replacement, Emmet Flood, has been through battles like this before. I think Emmet was brought in because he represented Clinton during their subpoena battle and knows a great deal about it, Giuliani said.
Giuliani already believes hes settled one case. The mayor argues that with the information now out about how the president reimbursed Michael Cohen for his payments to porn star Stormy Daniels, that case no longer has implications that campaign finance laws were violated.
I think the investigation with him [Cohen] largely fell apart, with the loss of the campaign finance possible violation which never existed in the first place, but they sure thought it did, Giuliani told ABC News Thursday night in a phone interview, adding that his client, President Trump, has nothing to worry about in this matter.

Mueller has been acting unconstitutionally because no crime was ever specified by RosenWeasel or Sessions for his investigation. Based on the scope of his investigation, Mueller has decided that he has the authority to investigate anything and anyone associated with the President.
Quite simply, Mueller and the deep state want to take down the President. Sessions, RosenWeasel, Dems and RINOs have no interest in ending the witch-hunt.
Mueller will continue his so-called investigation until the President resigns or is impeached - or until he (Mueller) is fired. I believe the President will need to fire Sessions and RosenWeasel to end the witch-hunt. His (the President's) party and his AG are feckless and complicit by their silence and indifference.

Could be they are as sick of Mueller as we are.
Some legal experts believe that two previous Justice Department opinions prohibit federal prosecutors.....
....including Mueller.....from charging a president with a crime.
Instead, the Constitution relies on Congress power to impeach for potentially criminal behavior.
Trumps lawyers could argue that he cannot be forced to testify under subpoena........
.......unless his testimony is necessary to indict someone else.

Mark Levin argues that Trump should essentially ignore Mueller and let the situation escalate to SCOTUS
While there are likely several reasons for Mueller, a primary reason is prophylactic. The Special Council is to ward off the effects of the coming legal assault and indictments on all things progressive
We need to perform a Citizens Arrest of Mueller on charges of Treason.

Levin advocates going on the offense, but I think in the context of any sort of request for meeting or supposed compulsion by force of executive subpoena (can the executive subpoena himself?)
Might be the same thing you are saying by "ignore," as in ignore or fight any request or demand for cooperation with this particular investigation. And McCarthy makes the same point with a bit more legal explanation.
On Mueller's side, issuing a subpoena is purely a political calculation. Win or lose in court, issuing a subpoena is a no-lose for him. Win or lose ultimately (and the case is a loser), the longer he keeps the intramural conflict going, the more successful he is.
I like the way Guiliani is out there every day in the news scoring points. This is what Trump needs - but I don’t think it would be as effective if he was AG.
Everyone knows that as Trump’s lawyer he is going to be 100% advocating for Trump, and that’s as it should be. Nobody is going to say it’s wrong - that he should be objective - that he’s being political or covering up. He’s his lawyer - he’s doing his job.
Obama’s AGs did that - and it was completely improper - they got away with it because they are Democrats and there was nobody in the MSM or GOPe that was going to call them on it.
But it was a shameful the way Obama weaponized his DOJ, IRS and FBI for politics. Shameful.
Now that Trump is POTUS he’s not weaponizing his entire executive branch for politics and it’s kind of refreshing - healthy for the nation.
But at the same time there is that part of me that wants to see Jeff Sessions out there with a machete chopping off heads like an Obama AG.
I think that Mueller is calculating that Trump will ignore the subpoena. That will give Mueller the rationale to continue the witch hunt until the SC decides on whether the subpoena is constitutional.
Now, if Trump does answer questions, he of course will be subjected to a perjury trap and additional evidence will be generated for fodder in an impeachment proceeding.
I agree with Levin who argues that Trump should demand why Mueller is violating the DOJs rules with respect obtaining a subpoena from the President and force them to make the case why issuing a subpoena to the President is constitutional.

Hannity had Levin as a recent guest on TV where Mark lays out the Constitutional law and related DOJ documents completely supporting Trump. Dont have a link to the clip right now

Why in the world would the President think Sessions was a bad choice? Sessions had all the appearances of being a Southern, white-hatted fighter.
