Mayor Rahm Emanuel called on President Donald Trumps Justice Department Thursday to hand over grant money to Chicago, after a panel of federal judges said the funds cant be withheld from so-called sanctuary cities.
The 7th Circuit Court of Appeals in Chicago upheld a nationwide injunction prohibiting Attorney General Jeff Sessions from requiring cities give immigration agents access to undocumented immigrants in their lock-ups in order to get certain public safety grants.
Emanuel quickly called an afternoon news conference at City Hall to trumpet his latest win in the citys lawsuit to stop the Trump administration from withholding the money.
The Trump Justice Department could actually say OK, were going to go forward with these grants, and lets fight the case out in court, Emanuel said, flanked by a crowd of aldermen and city lawyers. But they refuse to give municipalities like Chicago and other cities around the country the resources to fight crime and gun violence, because they think fighting us on the principle of being a sanctuary, welcoming city, is more important than helping the police departments get the technology they need to do a better job in public safety.
And Democratic U.S. Sen. Dick Durbin applauded the court decision, saying Trumps policy pressured local communities to join in the presidents mass deportation agenda.
The judges stongly worded ruling stated that Americas Founding Fathers understood a concentration of power threatens individual liberty and established the separation of powers as a bulwark against such tyranny.

The three judges who decided this case were appointed by Reagan, Ford and George H.W. Bush.
The basis for the ruling was that Congress appropriated the money without conditions, and Sessions tried to add conditions after the fact. This was held to be a violation of separation of powers. Nothing in the ruling prevents Congress from adding conditions to future appropriations.
The South should have sued Lincoln.

President Obamas Justice Department on Wednesday threatened to pull federal education dollars from North Carolina if the state does not repeal a law prohibiting people from using public restrooms of the opposite sex.
In a letter to Republican Gov. Pat McCrory, Principal Deputy Assistant Attorney General Vanita Gupta said the states HB2 law violates Title VII of the Civil Rights Act, which bars discrimination on the basis of sex in the workplace, and Title IX of the Education Amendments of 1972, which prohibit discrimination on the basis of sex in education.
The Department of Justice has determined that, as a result of compliance with and implementation of NC House Bill2, both you and the state of NC are in violation of Title VII of the Civil Rights Act of 1964, Ms. Gupta said.
The agency said North Carolina officials have until Monday to address the issue, or the state risks losing millions of dollars in federal education funding.

Chicago thug, Emanuel, only thinks he has won. He will never see a dime of the money.
Federal judges say or demand that the funds be paid. But the panel of federal judges do not control the budget.
If the amount of funds can be re-allocated, or set aside to accommodate other accounting priorities, then the amount of grant money can be locked up or reduced to near zero.

The Founding Fathers would be aghast at the whole grant process. Rahm would have been tarred and feathered long ago.
