Ninth Circuit wouldn’t get a vote. The President has the clear constitutional authority to federalize National Guard troops. When he does that, he gets to direct their employment. That’s the deal.
It wouldn’t matter. The President is CIC of the armed forces. It’s whether Congress would continue to fund it.
