Judge’s Death Gives Trump a Chance to Remake a Vexing Court

WASHINGTON — In the spring of 2014, a friend tried to nudge Judge Stephen Reinhardt, then an 83-year-old liberal stalwart on the United States Court of Appeals for the Ninth Circuit, into stepping aside from full-time duties so President Barack Obama could nominate a successor.

The friend, Erwin Chemerinsky, now the dean at the University of California, Berkeley, School of Law, said he had gently suggested to Judge Reinhardt that he and another longtime liberal figure on the San Francisco-based court make way while Democrats still had the power to assure that jurists with a similar philosophy would take their place. Judge Reinhardt swiftly rejected that notion and stayed on.

Now Judge Reinhardt, who died this past week at age 87, could very well be replaced by a nominee chosen by President Trump. The president suddenly has a chance to seat a judge with a markedly different judicial outlook, giving conservatives a greater voice on the liberal-leaning court, which has been a particular thorn in Mr. Trump’s side.

The president’s opening does not end there.

The vacancy is one of eight on the appeals court, which has 29 active judges — a vivid illustration of the larger opportunity for Mr. Trump to put an enduring stamp on the makeup of the federal judiciary nationwide by installing candidates of a more conservative bent.

“With a Republican Senate and no possibility of a filibuster, he can have whoever he wants on the circuit court,” Mr. Chemerinsky said. “It will dramatically change the Ninth Circuit.”

I’ve never understood how it is, that the 9th Circuit is so liberal. Have vacancies to be filled on that court, usually happened when a Democrat has been president? Did Democrats decide to pack that particular court, so that they could be sure liberal opinions would come out of a circuit court somewhere?

But then, what does it say about the 9th circuit, that they are overturned by the Supreme Court more than any other circuit?

All appointments are subject to Senate Confirmation. Beyond that, yes. He can appoint anybody.

First, Reinhardt was a hard core commie. Perhaps the worst of all on the 9th circuit. The death of this tyrant was a blessing to the republic. Not sure what the answer to your question is but my informed speculation is that it’s been that blue slip crap with Republican presidents only appointing judges acceptable to the rat senators of the states from which nominees came. Alex Kosinski, recently retired in disgrace, was an exception. I think it should be a top priority of the President to nominate for each of the vacancies

Yes. Senators were given the power to veto judicial appointments in their state. They are also instumental in appointing federal judges.

In Arizona, a hard core liberal judge ruled against the plain language of the Arizona Constitution so as to gut the State protection of the right to bear arms.

She was rewarded by Senator McCain with an appointment to the federal judiciary.

You have that correct McConnell will do what ever is necessary to stop who ever Trumps appoints. I think McConnell was in on the McCain no vote on Obama care and had it planned all the time. McConnell is a weasel and cannot be trusted

Of the many things that President Trump has done since raising his right hand, he’s created an atmosphere where they can’t even hide their bias and prejudices anymore. He’s has them in a total state of confusion and chaos. If any of the other Republicans had won, that guy wouldn’t publicly say anything like that, because he wouldn’t have to. He would know that, at best, one of the others(Cruz, being the exception, maybe) would nominate a “moderate” for that position, who would then suddenly go fully, Lefty ‘tard.

I’m not that much a student of history to know who the most Conservative politicians were/are. But, whoever he or they are, I want the President’s nominee to be way, way, way further to the Right than any of them. That’ll send the 9th Circuit and those judges into a tailspin.

As for your comment on McConnell, half of me says you’re 1000% right. The other half says the President will shame him into action. We shall see.

If Republicans and the Right, in general, played the game the same way, things wouldn’t be the way they are.

Republican’s could be walking around town like they owned the MFer. But, they’re too greedy, two faced and busy selling us out to the Koch’s and Tom Donohue.
