If our second amendment rights hang on trump we are screwed, He already signed gun control issues in the omnibus and is working on banning bump stocks through sessions. He likes common sense gun control. He is caving on the second amendment
First, bump stocks are really just a toy. I would agree that they shouldn't be outlawed. But look at what Trump actually did. He avoided having Congress vote in a new law to outlaw bump stocks. Instead he basically asked BATFE to decide that bump stocks should be controlled using existing law.
The fact is that the BATFE already looked at this issue in great depth and decided that the law didn't cover them. I would not be surprised at all if the Trump administration delivers the bad news to the anti-gunners at some time in the future that more legislation is required; hopefully at a time when Congress is too busy or uninterested. Barring that, I would expect an honest court to rule that existing law does not cover bump stocks. Time will tell.
The only other thing that I am aware of in the new bill is the so-called "FIX NICS" measure. My understanding is that this simply requires that federal agencies start doing what the law already requires them to do.
If you know of any other anti-gun provisions, let me know. If I am correct then we are getting about as little new controls as would be politically possible given the energy of our opposition at this time. In return we stand to have a pro-Second Amendment Supreme Court that could well last twenty or thirty years.
Some state constitutions contain their own "right to keep and bear arms" which helps to safeguard the right in those states. Unfortunately, we Californians are entirely at the mercy of the Supreme Court. So far, despite the Heller and McDonald decisions, the Ninth Circuit has not found any of California's infringements to be unacceptable. The present Supreme Court has refused to accept most cases, no doubt because the Court is not solidly on our side.
We need one or two more Justices like Gorsuch on the Court to insure that the decisions go our way and that California and other infringing states are forced to comply with all of the Bill of Rights.
One story I read today describes a school in Pennsylvania that now has buckets of rocks to throw at any bad guys that attack the school. That may seem like worse than nothing but it is actually quite important. It affirms the concept that a classroom full of innocent kids doesn't have to just hide and hope for the best. Instead the class is expected to fight for their lives. It really isn't such a big step from there to the point where they will accept better weapons in an attempt to win such a fight.
Trumps support for hardening and arming the schools is gaining some acceptance and this trend should continue.
