He’s not “using hearsay”, he is engaging in hearsay. “I heard XXX say XXX” is the definition of hearsay.

It depends on what the statement is offered for. If offered for the proposition that "XXX said XXX" (emphasis on the speaker, not for the truth of what the speaker said), then the statement is not hearsay.
