Another poster said this earlier, but if the hair stylist won’t testify and the image isn’t even in evidence but all they’ve got is the recording of the husband then, yeah, this whole case will fall apart and he’d be right to fight it. If he’d actually posted the photo on social media or even showed it to friends then this type of a revenge porn MIGHT be enforceable - there’s always an argument to be made that by sitting for and allowing the photo to be taken you are a willing participant in it - but without that... it very much does look politically motivated.
