One of Ruth Bader Ginsburg's great fears is that the federal judiciary will start to be seen as just another political branch of government divided along partisan lines like Congress, the U.S. Supreme Court justice said Tuesday.

Putting the cart before the horse...perhaps she should be concerned that the judiciary has become politicized, not whether it's been recognized as such.

A little late to be worrying about it, the court is political. Not as bad as 9th circuit but the supreme court has its own problems. Ginsburg is center of it. Too bad she doesn’t sleep as much as Sessions.

She’s figuring out that being hyper-partisan has diminishing returns as more and more people realize you’re playing for power and control rather than truth and justice.

Ginsburg has arrived at the endgame of her chosen path, where she can no longer act in any way at all without being seen as partisan.

You raise a very interesting and important point. Why is there so much disparity of opinion on the court, if not partisanship? Of course it’s partisan. If it were just a question of faithful interpretation of the Constitution, it clearly wouldn’t be so split, and wouldn’t be split along party lines. The reality is that the opinions rendered by the SC, and in particular the liberal judges appointed by Democrats, are opinions colored and driven by ideology, not by interpretation of the Constitution.
