Agree, I don’t see how it can be constitutional for a state to select a legislator by a method of chance. Either the person gets appointed to fill the post on an interim basis, or you have an election with a winner. It’s absurd.

On a happy note, it looks like the Dems will have a tougher time stealing this election. I guess they just stop counting once their person takes the lead. Oops!

If it’s in the state constitution, it’s constitutional.

200 years ago, running a second election would have been an extreme hardship and expense on everyone, voters and candidates. So it’s unsurprising that this method of tie-breaking was written in. Saves all kinds of time and hassle.
