A federal agent was arrested Tuesday for taking pictures in the womens restroom of a UW-Madison residence hall, the universitys police department said.
Justin T. Fahy, of Monona, allegedly went into a bathroom at Witte Residence Hall, 615 W. Johnson St., on Friday afternoon, put his cell phone under an occupied stall and took pictures, police said. The 27-year-old Fahy, who identified himself as a special agent for the federal Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), told police it was a misunderstanding and that he mistakenly entered the wrong restroom, said UW police spokesman Marc Lovicott.
Ashlee Sherrill, a spokeswoman for the ATFs St. Paul Field Division, confirmed Fahy is employed at the bureau.
Police obtained a search warrant for Fahys phone and reviewed security cameras from inside the residence. Lovicott said police determined he had been in the first-floor restroom for at least 14 minutes.
In addition, Fahys phone had been recently restored to a backup point from earlier this year, leading UWPD investigators to believe he was likely trying to delete evidence, Lovicott said.
Fahy was taken to the Dane County Jail on a tentative felony charge of attempting to take photos depicting nudity and disorderly conduct, Lovicott said, while he has also been formally banned from the campus.
Allegations like these cannot and will not be taken lightly, ATF Acting Special Agent in Charge Kirk Howard said in a statement. We will make sure that allegations of impropriety are handled appropriately.
