But rather than merely suing for libel, I submit that whats needed is a comprehensive class action suit alleging violation of the Sherman AntiTrust Act, and demanding triple damages as provided for under that act. And proving, not only that some of the claims against Moore are egregiously wrong, but that there is a pattern of this behavior against American society (primarily Republican voters) resulting in the wrongful prosecution of George Zimmerman, the attempted wrongful prosecution of the Duke Lacrosse 3, Rathergate, and innumerable other MSM abuses. Probably every October Surprise will fit that pattern. And "the dog that didnt bark in the absence of erroneous propaganda campaigns against Democrats.
The AP lost a Sherman case before SCOTUS in 1945 (on entirely different, much more limited grounds) - and SCOTUS has no reason to assume that the limited remedy demanded and granted in that case has caused the AP to stop being (as Adam Smith would put it) a conspiracy against the public. And given that telegraphy bandwidth is no longer scarce or expensive, the mission of the AP in conserving telegraphy bandwidth in spreading the news nationwide no longer makes the AP too big to fail.
